These Terms of Service govern your use of the Manaria platform and website. They constitute a binding contract between your special education center (the Subscriber) and Manaria. Please read them carefully before subscribing, as accessing or using our platform signifies full acceptance of these terms.
1. Definitions & Parties to the Agreement
"Manaria" / "The Platform": The cloud SaaS platform, website, and supporting software services for special education and learning difficulty center management. "The Center" / "Subscriber": The contracting entity that holds the organization account and assumes responsibility for its users and student data. "Beneficiary / Student": The child or individual whose records are managed via the platform.
2. Description of Service
Manaria provides cloud-based digital tools for center management, including student digital profiles, IEP goal tracking, session logging, attendance tracking, executive reporting, and parent communication channels. Platform features may evolve periodically without diminishing core contractual functionality during an active subscription.
3. Authority & Registration Eligibility
The Subscriber warrants that the individual completing registration is legally authorized to represent the center, that the center is legally licensed in its jurisdiction, and holds full authority to enter into electronic service contracts.
4. Center Obligations Regarding Student Data
The Center acts as the Data Controller for all student records, while Manaria acts strictly as a Data Processor (as detailed in our Privacy Policy). The Center agrees to:
- Obtain explicit parent or legal guardian consent prior to entering any minor's data into the system, prioritizing the child's best interests.
- Ensure all entered data is accurate, lawful, and properly authorized.
- Manage team member permission levels responsibly and remain responsible for account activities.
- Refrain from using the platform for unlawful, fraudulent, or harmful purposes.
5. Educational & Professional Disclaimer
Manaria is an administrative and documentation management tool; it does not provide clinical diagnosis, medical treatment, or legal evaluations. All IEP plans, evaluations, and goals are authored exclusively by center specialists who remain professionally accountable for clinical decisions. Educational content in our blog or templates is for general informational purposes and does not replace qualified professional evaluation.
6. Account Security & Credentials
Subscribers are responsible for safeguarding login credentials and notifying us immediately of suspected unauthorized access. Actions performed under verified center credentials are deemed authorized by the center.
7. Pricing, Subscription Billing & Cancellation
Subscription fees are billed in advance on a monthly or annual basis as selected during sign-up. Subscriptions may be canceled prior to the next billing cycle. Paid subscription fees for active terms are non-refundable unless required by law. Free trial periods are non-binding and do not automatically convert without explicit plan confirmation.
8. Service Availability & Maintenance
We exercise commercially reasonable efforts to maintain high platform availability. Scheduled maintenance breaks are communicated in advance whenever feasible. Temporary disruptions due to emergency maintenance or third-party infrastructure providers do not constitute a breach of contract.
9. Data Export & Handling Upon Termination
Upon subscription expiration or termination, centers retain ownership of their data. Subscribers are provided a 30-day grace period to export their records in standard electronic format. After this window, student data is securely deleted from our active databases in accordance with our deletion cycle.
10. Intellectual Property Rights
Manaria's software code, interface design, brand trademarks, and proprietary content remain the exclusive property of Manaria. Subscribers are granted a non-exclusive, non-transferable license during their active term. All student files, specialist notes, and center data remain the sole intellectual property of the Subscriber.
11. Limitation of Liability
The platform is provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by law, Manaria shall not be liable for indirect damages, lost data due to credential negligence, or clinical decisions made within the center. Our total aggregate liability shall not exceed the subscription fees paid by the center during the 12 months preceding the claim.
12. Governing Law & Updates
These terms are governed by and construed in accordance with the laws of the United Arab Emirates. We reserve the right to update these terms periodically, with notice provided on our website. Continued use of the platform after updates signifies acceptance of revised terms.
